The Demise of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the crisis sparked by the introduction of a new 28-article proposal for achieving ceasefire appeared – briefly – to have been defused. A American diplomat spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its retaliation: an extensive attack of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The succession of conflicting incidents captured the grim essence of the recent timeframe. By day, political struggles are waged: hopeful statements are delivered from different nations. Significant resources is devoted on managing certain initiatives. By night, the Kremlin clearly shows the world that, for them, war remains the key method for achieving "peace".

Nighttime Reality

As military strikes progressed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was laid bare. Ukraine is capable of detecting projectile deployments from enemy soil, a capacity afforded by current data. From observation points, military aircraft that had been deployed to counter approaching guided weapons roared overhead – sophisticated military planes provided to Ukraine by NATO members.

Soon thereafter, Kyiv's anti-aircraft weapons engaged: several firings targeted at a Russian ballistic missile. This was a modern interception technology at work, most likely delivered by allied countries. Every firing shakes the surroundings, shaking the windows. The moment of terror quickly transforms into resigned acknowledgment: maybe the hostile projectile won't hit its mark this time, sparing the city from catastrophe and further power outages.

Ongoing Risks

Soon after, a automatic firearm opened up on a unmanned aircraft in the vicinity, part of a rapid response unit – probably imported technology. Regrettably, the projectiles didn't strike the hostile drone – it pressed on overhead toward its target.

With pauses, this persisted until dawn. Kyiv faced the morning news: multiple fatalities, devastation and infrastructure problems in numerous residences as a result of the nocturnal offensive. As always, everyone still maintained normal activities – living the war. But those full day encapsulated Ukraine's vital need on Western support – a dependence that European nations are evidently unprepared to substitute in the immediate future.

Failed Diplomacy

The 28-point plan from Washington generated strong feelings, controversy and serious worry – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new proposal from US leadership adheres to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with allied governments, manages to fend off. They stabilise the situation but never actually achieve victory. This cycle will, certainly, endure.

Strategic Calculations

It is easy to blame particular leaders of repeatedly advocating Moscow's conditions. But that does not seem to be the whole story. Washington operates on a premise understood by seasoned negotiators: you cannot achieve through diplomacy what you have lost on the battlefield. The US administration believes that it is unfeasible to pressure the Kremlin to surrender the land that it presently holds in Ukraine's occupied territories.

The challenge is that while accepting these circumstances, US leadership does little to deter Moscow, through words or deeds, from believing that the status quo will not shift further in its advantage in the months ahead.

Opposing Positions

Therefore, the Kremlin is convinced that the clock favors them – that Ukraine and its allies are nearing depletion. Their motivation to agree to terms that does not give them the maximum possible gain is virtually nonexistent. There may be multiple initiatives to end hostilities, but they will carry on as long as Russia's leader remains supremely confident in the result.

On the contrary, Kyiv believes that Ukraine can still hold out, slowly losing civilians and areas but averting a total frontline collapse until circumstances change in its advantage.

Present Conditions

Objectively, there are no actual prerequisites for a truce. Now, subjective factors are coming into play: political desires to broker a ceasefire and obtain worldwide acknowledgment, and Kyiv's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the national cause against any proposal Kyiv finds unsuitable, so that their focus does not shift toward internal issues. And although their task will now be significantly challenging after recent developments, it remains very improbable that this will alter their fundamental strategy.

These two forces are guiding negotiations.

Summary and Prospects

It took a just a single week to terminate the proposed articles of the latest plan. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the other European countries, along with pacifying measures of negotiators, and finally, latest revelations, all achieved their purpose.

While new initiatives based on previous concepts are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist political attacks from Washington that are founded on Moscow's terms and show particular unwillingness to modify developments, if they remain united and enhance their military capacity at a much faster pace. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the predictable period, mainly require sustained allied backing.
